Terms of Use

These Terms of Use (“these Terms”) set out the conditions for using mique, a meal-logging app (“the app”) provided by model.ai Inc. (“we”). By using the app, you (“the user”) agree to these Terms.

2. What the app is

  • The app is a tool for recording meals and weight. From the information you enter, it calculates and shows a calorie target, a lower limit and nutrient targets as guideline figures.
  • The app does not provide medical care, diagnosis or treatment, and is not a substitute for a doctor. Nor is it nutritional guidance from a dietitian or registered dietitian.
  • The app does not promise weight loss or any other health effect.
  • Check with a doctor before making decisions about your health.

3. Who the app is for

  • The app is for people aged 18 and over.
  • The app’s calorie targets are not intended for people to whom any of the following applies. If you answer that one applies in the “Before you start” check, the app does not give you a calorie target.
    • You are pregnant or breastfeeding, or may be pregnant
    • You are being or have been treated for an eating disorder
    • A doctor has given you instructions about what to eat as part of treating a condition
  • If any of these applies to you, please talk to a doctor or midwife about goals for food and weight.

4. Accounts

  • You use the app by signing in with Apple.
  • You are responsible for looking after your device and the Apple account you use to sign in.
  • You can delete your account and records at any time with “Delete account and records” in the app’s Settings. Deletion cannot be undone.

5. AI estimates

  • The app uses AI to work out the dish and amount from photos or text you write, and to write reflections. AI results are estimates and may contain errors.
  • Please check records read by the AI and correct them where needed. You can correct records later.
  • To use AI, you need to give a separate consent, apart from these Terms, to the provision of data to companies outside Japan (section 4 of the Privacy Policy). Without it, you can still record meals by searching the food composition tables or entering them yourself. You can withdraw that consent at any time under “Reading meals with AI” in the app’s Settings.

6. Your records and personal information

  • The rights in what you record (including photos and text) remain with you. We handle it only as far as needed to provide the app.
  • We handle your personal information in accordance with the Privacy Policy.

7. Prohibited conduct

When using the app, you must not:

  • break the law or public order and morals, or take part in crime
  • access our servers or networks without authorisation, attack them, or place an excessive load on them
  • decompile, disassemble or otherwise analyse the app beyond what the law allows
  • impersonate another person
  • interfere with the operation of the app
  • send other people’s personal information, or photos of other people or images in which others hold rights, without the right to do so
  • infringe our rights or interests or those of third parties
  • do anything else that we reasonably judge to be inappropriate for the operation of the app

If you do any of these, we may restrict all or part of your use of the app.

8. Fees

The app is currently provided free of charge. If we introduce paid features, we will show what they are and what they cost, in the app or on this page, before you pay.

9. Changes to and suspension of the app

  • We may change the app or stop providing it. If we stop providing it, we will announce this in the app or on this page as far in advance as we can.
  • For equipment maintenance, faults, natural disasters or other unavoidable circumstances, we may suspend all or part of the app temporarily without notice.

10. Warranties and liability

  • The calorie target, lower limit and nutrition values the app shows, AI estimates and reflection text are guideline figures. We do not guarantee that they are accurate or complete, or that they suit your purposes.
  • If you suffer loss or damage through our wilful misconduct or gross negligence, we will compensate you for it.
  • If you suffer loss or damage through our ordinary negligence (negligence other than gross negligence), we will compensate you for the direct and ordinary loss or damage you actually suffer.
  • No provision of these Terms applies to the extent that it is invalid under the Consumer Contract Act of Japan or other laws.

11. Changes to these Terms

  • We may change these Terms in either of the following cases (Article 548-4 of the Civil Code of Japan):
    • the change is in the general interest of users
    • the change does not go against the purpose of the contract and is reasonable in light of the need for the change, the appropriateness of the new content and other circumstances relating to the change
  • Before a change takes effect, we will announce on this page that these Terms are changing, what the new content is, and the date it takes effect.

12. Governing law and jurisdiction

These Terms are governed by the laws of Japan. Any dispute between us and you relating to the app shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
